Terms of Service

These terms are an agreement between your business and Vacaytrip LLC, a Florida limited liability company that runs MailMustang. By creating an account, you agree to them.

1. Your account

  • MailMustang is for businesses and organizations. You must be at least 18 and able to agree for your business.
  • The details you give us, including your website and how your list was built, must be true and kept up to date.
  • Keep your password private. You are responsible for everything done through your account.

2. Approval and sending limits

A person at MailMustang reviews every business before it can send. We may ask for more information, and we may decline any application. Approved accounts start with low daily and monthly limits. We raise them as an account shows good results, and we may lower them at any time.

3. What you may send

You may only email people who asked to hear from your business. In particular:

  • Never use bought, rented, shared, scraped or appended lists, or addresses you collected for another purpose.
  • Keep a record of how and when each person agreed, and show it to us if we ask.
  • Send only from a domain you control and have verified with us.
  • Use honest sender names and subject lines, and say clearly who the email is from.
  • Include a real postal address. MailMustang adds it and an unsubscribe link to every email, and you may not remove or hide either one.
  • Follow every law that applies to your email, including the US CAN-SPAM Act and the laws of the places your recipients live.

You may not use MailMustang to send:

  • Anything illegal, or anything that infringes someone else's rights.
  • Phishing, malware, or links meant to deceive.
  • Misleading health, financial or get-rich-quick claims.
  • Sexually explicit material, or content that harasses, threatens or promotes violence.

You also may not try to get around our limits, reviews or safety checks, or open more accounts to do so.

4. Bounces, complaints and pausing an account

Addresses that bounce, mark your email as spam or unsubscribe are never mailed again from your account. MailMustang stops an account automatically when too many of its emails bounce or draw spam complaints. A person reviews it before it can send again.

We may pause or close an account straight away, without notice, if we believe it breaks these terms or puts other customers' delivery or our email provider's service at risk.

5. Your contacts and content

Your contact lists and the emails you write belong to you. You give us permission to store, process and send them only to provide MailMustang to you. You are responsible for having the right to use them. We handle your contacts' information as described in our Privacy Policy, and we never use it for our own marketing or share it with other customers.

6. The pilot and prices

MailMustang is free during its private pilot. Before we start charging, we will publish our prices and give you at least 30 days' notice by email. You will not be charged unless you agree to a paid plan.

7. Changes to the service

MailMustang is new, and we will add, change and remove features as we learn. We work to keep it available and to deliver your email, but we cannot promise that it will always be available or that every email will reach an inbox. Mailbox providers decide what to accept.

8. Ending your account

You can stop using MailMustang at any time. Email [email protected] to close your account. We delete your account data within 30 days of closing it, and our encrypted backups are deleted within a further 35 days. We keep the list of addresses that unsubscribed or complained, so that they are not emailed again if the account is reopened. We also keep the record of key account actions for security and to settle disputes.

9. Disclaimer

MailMustang is provided as is and as available. As far as the law allows, we make no other promises about it, including that it is fit for a particular purpose.

10. Limit of liability

As far as the law allows, Vacaytrip LLC is not liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim about MailMustang is limited to the greater of what you paid us in the 12 months before the claim and $100.

11. Claims about your email

You will defend and compensate Vacaytrip LLC for claims brought by others because of the email you sent, the lists you used, or your breaking these terms or the law.

12. Changes to these terms

We may update these terms. For an important change, we will email you at least 30 days before it takes effect. Using MailMustang after that means you accept the new terms.

13. Law and disputes

These terms are governed by the laws of the State of Florida. Any dispute will be handled by the state or federal courts in Seminole County, Florida.
